GLOBAL VILLAGE SEASON 28 RAFFLE DRAW TERMS AND CONDITIONS
These Terms and Conditions (the ‘Terms and Conditions’) apply to the Global Village - Dubai LLC (‘We’, ‘Our’, ‘Us’ of‘ GV’) Season 28 (from 18 October 2023 to 28 April 2024) Raffle Draw (“Draw”).
The Draw shall run for a term starting from and including 29 January 2024 and ending on 7 March 2024 (the ‘Competition Period’).
1. ELIGIBILITY
1.1 The Draw shall be open to individuals who, during the Competition Period:
(a) are twenty-one (21) years of age or older; and
(b) Visit Global Village and purchase seven (7) entry tickets to Global Village at gate (‘Entry Tickets’).
(c) In case the winning raffle draw ticket is filled with details of anyone who is under the age of 21 years, the Prize will be registered in the name of the official adult guardian of the winner. For the avoidance of doubt, in the event of failure to provide relevant guardianship information and/or documents relating to the person under the age of 21 years, GV reserves the right to withdraw the Prize in its entirety.
1.2 The following individuals are NOT eligible to participate in the Draw:
(a) Employees, officers, directors, agents and representatives (including their family members) of Dubai Holding LLC (which shall include all of its verticals and subsidiaries);
(b) Employees, officers, directors, agents and representatives of any government department, advertising, promotional, public relations, legal or other professional agency or firm providing services/advice directly to GV in relation to the Draw and related matters; or
(c) Global Village ID card holders and/or employees of GV, investors or partners.
2. AGREEMENT TO TERMS AND CONDITIONS
2.1 By entering into the Draw, participants:
(a) confirm that they have read and accepted the Terms and Conditions;
(b) agree to be fully and unconditionally bound by these Terms and Conditions and any amendments to them;
(c) represent and warrant that they meet the eligibility requirements; and
(d) will accept the decisions of GV, as they relate to the Draw, as final and binding.
3. COMPETITION
3.1 Entry Times
3.1.1 Entries to the Draw will be accepted starting on 29 January 2024 (‘Start Date’) and ending at 02:00AM on 8 March 2024 (‘End Date’).
3.2 How to Enter
3.2.1 In order to enter the Draw, participants must, between the Start Date and the End Date, purchase seven Global Village Entry Tickets, at the gate and drop the raffle draw ticket in the raffle draw box:
Step 1: Purchase seven Global Village Entry Tickets at any of the ticket counters on site and get one raffle draw ticket
Step 2: Fill in the required details in the raffle draw ticket using dry ink pen
Step 3: Drop the raffle draw ticket inside any of the raffle draw boxes on site
3.2.2 Each entry resulting from a purchase of seven Global Village Entry Tickets at the gates constitutes one entry into the Draw. Entry Tickets which is free of charge, unpaid or complementary does not permit entry into the Draw.
3.2.3 Participants consents to and grants GV and its affiliated companies the right to use and publish their name and photograph in public and social media for the purposes of the Draw.
3.2.4 Any violation of the Terms and Conditions (determined by GV in its sole and absolute discretion) may result in the disqualification and the revocation of any Prize and/or any other privileges awarded to a Winner in relation to the Draw.
3.3 The Draw Winner
3.3.1 There will be 1 winner of the Draw, who shall be selected at random by a representative from Dubai Economic and Tourism Department on 8 March 2024 (the “Raffle Draw Date”) from valid Draw entrants and is confirmed in accordance with these Terms and Conditions (the ‘Winner’).
3.3.2 GV shall announce the Winner on Raffle Draw Date.
3.3.3 Winner will be notified on the contact details provided by the Winner on his/her entry into the Draw. Winner is required to then be physically present in Global Village, as directed by GV, for official public announcement and present valid photographic ID (passport or Emirates ID) to GV. In the event that a winner fail to be present in Global Village as directed, then that person may be considered as forfeiting the Prize and GV has the right to redraw the Prize from the Winner until such time as there is one (1) confirmed winner.
3.3.4 Non-winners will not be notified.
3.4 The Prize
3.4.1 The Winner will receive the following::
1 x Geely Tugella vehicle
(vehicle type, specifications, model, colour, year, etc. to be in GV’s full discretion).
3.4.2 For the avoidance of doubt, a Winner is only eligible to win one Prize (i.e. one vehicle per winner).
3.4.3 The Winner is individually responsible for the collection or, should they elect, delivery of, the allocated vehicle by no later than 8 June 2024 (unless later dates are agreed by GV). Without prejudice to the foregoing, in the event that the Winner wishes to have their allocated vehicle delivered, or if the Winner is not capable of having a car registered in the United Arab Emirates, then that Winner shall be fully responsible for the arrangements, costs and expenses of delivery of their allocated vehicle.
3.4.4 The Winner is individually responsible for providing all identification cards and documents requested by GV and/or the party who will be supplying the vehicle, to be able to claim their allocated vehicle.
3.4.5 The party supplying the vehicle will (if able to do so) initiate the registration process to register the vehicle under respective Winner’s name with the respective government authorities and departments in compliance with RTA and local regulations concerning car ownership within UAE. The Winner is required to do all things necessary and requested for completing such procedures.
3.4.6 The Winner consent, acknowledge and agree that GV and its affiliates have the right to publish and announce their full name, photographs and videos through any and all media formats including but not limited to the Global Village official website, and social media accounts.
3.4.7 For the avoidance of doubt, GV is under no obligation to announce the name of any Winner.
3.4.8 Prizes will be awarded only if properly claimed.
3.4.9 There shall be no (a) replacement of the Prize with another prize or item; (b) transfer or assignment of the Prize to another person, (c) redemption of the Prize for cash; (d) refund on the Prize; (e) combining the Prize with any other offer or promotion.
3.4.10 GV reserves the right, exercisable at any time in our sole discretion, to substitute the Prize (or portion thereof), provided that the substitute prizes are items of comparable or greater value.
3.4.11 The Prize is awarded on an “as is” basis and without any warranty or guarantee, either expressed or implied by GV, and without any liability to GV. Any warranty or guarantees required by law in relation to the Prize will be provided directly by the party supplying the Prize. Participants understand that a Prize is subject to its own terms and conditions directly with the party supplying the Prize, which must be adhered to by the Winner.
3.4.12 In the event that the Winner does not collect thePrize either:
(a) within 7 days of notification that the vehicle is registered and ready for collection; or
(b) by 8 June 2024
whichever occurs first, the Winner shall be considered to have forfeited the Prize and the Prize shall be handed over to the Dubai Economic Department.
3.4.13 Winners acknowledge and agree that he/she may be expected to take part in reasonable publicity activities and promotional events promoting Global Village.
4. THE INFORMATION SUBMITTED BY YOU
4.1 Participants’ entry into the Draw must be in accordance with these Terms and Conditions. GV reserves the right to reject any entry into the Draw without any explanation or prior notice.
4.2 GV respects the privacy of participants and hereby undertakes that any and all information provided by participants will only be used as stated in these Terms and Conditions, in accordance with applicable data protection rules and regulations and as per GV’s Data Privacy https://globalvillage.ae/en/privacy-notice and Cookies Policy https://globalvillage.ae/en/cookies-notice .
5. LIMITATION OF LIABILITY
By entering the Draw, participants agree, to the fullest extent permitted by law, to release and hold harmless GV and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, damage, illness, injury, death, litigation, claim, directly or indirectly, whether caused by negligence or not, from: (i) individual’s participation in the Draw and/or the acceptance, possession, use, or misuse of any Prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or internet service; (iv) unauthorized human intervention in any part of the entry process or the Draw; (v) electronic or human error in the administration of the Draw or the processing of entries.
6. DELIBERATE DAMAGE
7. DISPUTES
These Terms and Conditions are governed by the laws of the emirate of Dubai and the laws of the United Arab Emirates, where applicable. The Courts of Dubai shall have exclusive jurisdiction to hear and decide any suit, action or proceedings, and/or to settle any disputes, which may arise out of or in connection with these Terms and Conditions. Notwithstanding the foregoing, GV may seek injunctive or other equitable relief to protect our rights in any court of competent jurisdiction.
8. GENERAL
8.1 GV and any employees, officers and affiliates may use and disclose (to the fullest extent permitted by applicable law User’s name, city and state of residence, photograph, any oral or written statements, footage, and/or likeness for advertising, trade and/or any other purposes in any media and/or social media and/or on TV now or hereafter known throughout the world in perpetuity, without further compensation, permission or notification.
8.2 GV is hereby granted an authorization and consent to conduct any and all verifications required concerning participants’ and Winner’s identity. GV reserves the right to verify participants’ eligibility at any time, including requiring photographic identification, proof of age and residency.
8.3 GV reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Draw or website or violates any part these Terms and Conditions.
8.4 These Terms and Conditions are provided in both English and Arabic. In the event of any conflict between the two versions, the English version shall prevail.
8.5 GV reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Draw should any epidemic, pandemic, wide-spread disease or virus, non-authorized human intervention, fraud, unpredictable weather circumstances such as but not limited to heavy rainfall, storms, or floods, or other cause beyond GV’s control corrupt or affect the administration, security, fairness, or proper conduct of the Draw.
8.6 GV reserves the right, in its sole discretion, to modify, suspend, and/or terminate this Draw and the Terms and Conditions (or portion thereof) without any notice to the Users, at any time and for any reason whatsoever especially if virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or proper play of the Draw or for any other reason.
8.7 Failure by GV to enforce any of its rights under these Terms and Conditions, at any stage, does not constitute a waiver of those rights.
8.8 Should any provisions of these Terms & Conditions become illegal or unenforceable, such illegality or unenforceability shall not affect the remainder of these Terms and Conditions to the fullest extent permitted by law, unaffected and valid. The illegal or unenforceable provisions shall be replaced by a valid and enforceable provisions which best reflects GV’s intentions in a legal and enforceable manner with respect to the invalid or unenforceable provision or portion thereof.
